Tourism Law 2017: A new element promotes tourism development

After over 10 years of executing the Tourism Law (2005), many lessons are drawn. There are positive factors that pave the way for tourism development but at the same time there are also many problems creating barriers. This shows that the institutional framework has not meet the tourism development needs and trends.

Therefore, the innovation ideas in Resolution No. 92/NQ-CP dated 8/12/2014 by the Government on some solutions to promote tourism development in the new period and Resolution No. 8/NQ-TW dated 16/1/2017 by the Politburo on making tourism become a spearhead economic sector were adopted and institutionalized in the revised Tourism Law adopted by the National Assembly on June 19, 2017. The new elements with high openness are guided synchronous implementation. With the strong commitment of the central government to the local government, the enterprises and people will stimulate potentialities and stimulate tourism breakthrough in the next period.

Firstly, the respect for the principles and market economy rules are shown in the Law. Thereby, the Law regulates the relations associated with tourism as the synthetic service economy with the profound cultural, inter-sector, inter-region, wide and deep integration and high socialization contents. The economic factor and the value rules put the profits as the core and the “cost-profit” relation as the foundation; thereby, creating the driving force to pursue the objective of subjects. This point of view generates a fair, impartial and strict playground under the competition law. The healthy competition trend based on quality, efficiency, brand and reasonable costs shall become prominent. Vice versa, the grabing-away competition is based on the minimum cost, the low-cost tours shall be gradually replaced and eliminated.

Secondly, the new core factor- the dentification of tourists as the center- shall generate the demand-orientation mechanism. The efforts from Supply must meet the level, structure and features of the market demand. The tourists generate demand signals and satisfaction signals for services provided by the service suppliers at the same time. The research and consultancy for the market and tourism products shall be attached importance. The tourism product design and infrastructure development investment program, the procedures for service supply and destination management are oriented at value added to the beneficiary, experience values and satisfaction of tourists.

Thirdly, the role of the state is increasingly evident in planning, inspection and development support, especially in formation of a new balance of the industry structure, inter-sectoral relation and territorial and regional structure. The State has no longer interfered in the economic relations between entities but has given the core factors to stimulate and remove barriers and define transparency of interests and responsibilities; Limited and targeted to eliminate conflicts of interest between sectors, fields, localities and counterparts.

Further, the tourism priority policies reflected in the Tourism Law will raise the tourism awareness in the whole society; provide maximum profits for tourists from visa procedures, airway, road, waterway, railway and destination access conditions and vehicles, activities and tourism experience in a convenient and diverse way;

The policies for removing obstacles, encouraging tourism enterprises will create attractive and strong motivation to attract and improve investment capital in tourism in the coming time. The tourism infrastructure investment explosion, focus on the development of dynamic tourism areas, new destinations with world class brands as well as unique and diverse tourism products will open up a new path for tourism development in Vietnam.

Fifthly, the public-private partnership mechanism is also reflected in the revised Tourism Law. This is the key to attract resources to focus on the goal. The Tourism Development Assistance Fund will benefit from this mechanism and provide incentives for stakeholders and beneficiaries of the Fund’s development programs and projects. Especially the tourism advertisement and promotion will have a fundamental change in efficiency and professionalism.

Sixthly, the state will facilitate the resident community’s participation in tourism development. This potentially huge resource will be mobilized from people. The resident communities will be raised awareness, thereby being facilitated and supported and protected during participation and shared tourism benefits. It can be said it is the institutional innovation in taking advantages of people’s strength for tourism development. The community tourism, agricultural tourism, rural eco-tourism, shared tourism, etc will have strong development conditions. The role and image of the “master” of destination will be formed and honored from the resident community directly or indirectly participating in welcoming and serving tourists with love, pride, self-respect for the homeland and nation.

It can be said that the new opportunity for tourism development is coming from the openness of the guidlines and policies of the Party and the State that has been institutionalized in the Tourism Law. Within the innovative institutional framework, Vietnam tourism will have a strong development commensurate with the great potentiality of the country, people and culture of Vietnam./.
